Scope and Contents

The papers consist of the slip files for cases heard before the court while Winter was as an associate judge for the U.S. Court of Appeals for the Fourth Circuit. The papers span the years 1966 to 1981, and are arranged numerically by case file number. These are appellate court records which deal with interpreting points of law which may have been violated by a lower court. The information in the slip files documents the judges' re-action to and final decision on the briefs presented before them. These papers include cases that Winter did not sit on since the Fourth Circuit judges sent copies of their cases to other judges not sitting on a case in order to keep them informed.

The Fourth Circuit handled many cases dealing with school desegregation and racial, sexual, and age discrimination, and it is for the history of these issues that the papers have the most research potential.

Each slip file consists of bench notes, correspondence, and drafts and final opinions in the case. Some of the final opinions in these papers are published in the Federal Court Reporter, but some are not. The one thing missing from these files is the brief prepared by the attorney arguing the case. Judge Winter gave his copies of briefs to the University of Maryland Law School. One copy of all briefs remains with the Court Clerk, whose office is in Richmond.

Biographical Note

Harrison L. Winter was born in Baltimore in 1921. He graduated cum laude from the Johns Hopkins University in 1942 and received his law degree from the University of Maryland Law School in 1944.

Judge Winter was in private practice with the firm Miles, Walsh, O'Brien and Morris (later Miles and Stockbridge) from 1946-48 and 1951-59. Before being appointed judge, he served in several public offices. From 1948 until 1951 Winter served as assistant attorney general for the state of Maryland, and from 1954 until 1955 he served as deputy attorney general for the state. In 1959 Winter was appointed Baltimore City Solicitor, a position he held until 1961.

Winter served as a judge for the U.S. District Court for the District of Maryland from 1961 until 1966. He was appointed Associate Judge of the U.S. Court of Appeals for the Fourth Circuit in 1966 and Chief Judge of this court in 1981.

Immediate Source of Acquisition

Judge Harrison L. Winter donated his court papers to the Johns Hopkins University on May 22, l987. The first series was stored in the Federal Records Center in Philadelphia. These records were retired by the Judge in l97-? when he moved his office into the U.S. Courthouse at 101 W. Lombard Street in Baltimore. The second series was sent to the University directly from the Judge's office in the courthouse.

In August 1990, Winter's secretary transferred 113 boxes of files from his courthouse office.

The papers have not been fully processed. There was a preliminary sporting in July 1987 followed by additional partial processing in April 1995 by Cynthia H. Requardt.
